The American Bar Association (ABA) has initiated legal action against the administration of President Donald Trump, contesting executive orders that it considers unconstitutional and harmful to law firms across the United States. The lawsuit, filed in federal court in Washington, D.C. on Monday, argues that the administration has engaged in a campaign of intimidation aimed at major legal firms by issuing a series of executive orders that target them based on their prior clients and affiliations.

According to the ABA’s complaint, these executive orders are coercive measures designed to force lawyers and their firms to abandon clients and policy positions that do not align with the President’s preferences. This represents a significant concern for the integrity of the legal profession, the ABA argues, as it undermines the essential role of lawyers in maintaining a functional and fair judiciary. The ABA, which serves as the largest voluntary association of legal professionals in the nation, characterized these attacks as “uniquely destructive.”

Notably, the lawsuit names several officials, including Attorney General Pam Bondi, FBI Director Kash Patel, and Secretary of State Marco Rubio. The ABA emphasizes that without competent legal representation, the judiciary’s function as a counterbalance to executive authority is severely diminished.

In a related development, four law firms have separately challenged the Trump administration’s executive orders, which stripped certain lawyers of crucial security clearances and restricted their access to federal contracts and government officials. Courts in Washington have sided with the firms, issuing temporary or permanent injunctions against the administration’s actions. One of these firms, Susman Godfrey, is now representing the ABA in this broader legal battle.

In response to the ABA’s legal measures, White House spokesperson Harrison Fields dismissed the lawsuit as “clearly frivolous,” asserting that the ABA lacks jurisdiction over presidential discretion related to government contracts and security clearances. He expressed confidence that the administration would prevail in this matter.

Despite the setbacks faced by the administration in federal court, several law firms have opted to strike voluntary agreements with the President, committing to provide nearly billion in pro bono legal services in an effort to mitigate the potential impact of similar executive orders in the future.

The lawsuit marks a significant escalation in the ongoing conflict between the ABA and the Trump administration, which has previously cut funding to the organization and sought to limit its influence over the vetting of federal judicial nominees. Furthermore, recent warnings were issued to the ABA regarding its accreditation powers in relation to law schools and their diversity initiatives.
