In a burgeoning legal conflict within the culinary landscape, popular Washington, D.C., bagel chain Call Your Mother has initiated a trademark lawsuit against a Long Branch, New Jersey, establishment named Call Your Bubbi. The suit has been filed in the U.S. District Court for the District of New Jersey, and centers around accusations that Call Your Bubbi has created a brand that is “confusingly similar” to that of Call Your Mother, which operates 25 locations nationwide.

Call Your Bubbi, a kosher-certified bagel café, opened last year within the Wave Resort and has since captured the community’s attention with its traditional bagel offerings. The core of the dispute rests on the contention by Andrew Dana and Daniela Moreira, the married couple behind Call Your Mother, that their brand identity is being compromised by the New Jersey café’s name and branding. The couple asserts that the similarity in names, combined with overlapping design elements, could mislead customers and harm their established business.

The lawsuit has gained traction on social media and within food circles, bringing attention to trademark laws and the commercial viability of such disputes. Dana remarked on the unexpected virality of the situation, expressing disbelief over the widespread attention it has garnered. Although Call Your Bubbi’s owner, David Mizrahi, has not commented publicly, the legal implications of the case are noteworthy.

According to court documents, Dana and Moreira have secured the trademark for the phrase “call your mother” as it pertains to restaurant operations, alongside a distinctive logo resembling a rotary phone that evokes a bagel’s shape. They contend that Call Your Bubbi not only mimics their branding elements but also initially operated under the name “Bubbies Bagels,” pivoting to the more contentious label later.

The lawsuit highlights the cultural significance of the terms “mother” and “bubbi” within Jewish tradition, associating them with warmth and familial connections. Call Your Mother is represented by Matthew Homyk, a Philadelphia-based attorney specializing in intellectual property, as they seek legal remedies to address what they characterize as unfair competition.
