A federal judge has granted Carmine Agnello, the grandson of the infamous mobster John Gotti, a two-month postponement of his sentencing linked to a .1 million COVID-19 fraud case. This decision allows Agnello to donate a kidney to his ailing mother, Victoria Gotti, who has recently been diagnosed with chronic kidney disease. U.S. District Court Judge Nusrat Choudhury approved this extension, contingent upon the successful completion of the transplant scheduled for August 3.

As it stands, Agnello was due to face sentencing on Monday for his role in defrauding federal COVID relief programs. The judge emphasized the justification for the deferment after receiving assurances from medical professionals regarding the scheduled operation. Agnello’s new sentencing date has been set for September 18. However, the court requires confirmation by August 4 that the kidney transplant has been carried out.

Victoria Gotti, who is the daughter of John Gotti and a notable figure in her own right, has been advocating for her son since March, pleading for leniency regarding his case. In letters to the court, she has referred to her son as a “Miracle Child” and has expressed doubts about the legitimacy of his fraud charges. Agnello pleaded guilty in 2024 to fraudulently applying for three COVID relief loans for his business, Crown Auto Parts. He was accused of inflating payroll figures and falsely claiming to have no criminal background, ultimately misusing approximately 0,000 of the loan for personal investments in cryptocurrencies.

Prosecutors initially expressed skepticism toward the request for an extension, highlighting a past adjournment request made by Agnello under similar circumstances. However, during a recent conference call, the prosecution stated they would accept the extension as long as there is evidence of the medical operation taking place.

The defense attorney, Robert Beltrani, expressed hope that the surgery would proceed without complications for both Agnello and his mother.
