The Albemarle County Police Department, which is spearheading the investigation, confirmed that Fitzpatrick moved to Ohio shortly after the inquiry into his activities commenced. On April 22, 2025, local law enforcement in Ohio, cooperating with Albemarle authorities, arrested him. He is currently being held in custody in Ohio, where he awaits extradition back to Virginia to face the charges leveled against him.

The allegations against Fitzpatrick stem from an incident in which he purportedly filmed a consensual sexual encounter with a victim without their consent or knowledge.
