Four years after multiple allegations of sexual harassment came to light, prominent San Diego attorney John Gomez is facing a new legal challenge. The founder of Gomez Trial Attorneys is now the subject of a lawsuit filed in San Diego Superior Court that claims he abused a client. The case, identified as Jane Doe v. Gomez, was initiated by an unnamed woman who opted to represent herself in the matter.
The lawsuit accuses Gomez, a former federal prosecutor, of various legal malpractices including malpractice, breach of fiduciary duty, fraud, and intentional infliction of emotional distress. Central to the plaintiff’s allegations is the claim that Gomez repeatedly offered to send her nude photographs of himself. The plaintiff contends that Gomez failed to advance her medical malpractice case, which she believed he had undertaken as her attorney, and instead exploited their professional relationship for inappropriate purposes.
Gomez has flatly denied the allegations, asserting that the woman was never a formal client. He characterized her as mentally unstable and suggested that she was trying to financially benefit from what he called false claims. In an official statement, Gomez Trial Attorneys accused the plaintiff of stalking Gomez under the guise of seeking legal assistance for various matters. According to the firm’s assertion, once Gomez became aware of what he perceived as her ulterior motives, he halted all communication with her.
The plaintiff remains anonymous in the court documents, but her complaint indicates that her fear of terminating the lawyer-client relationship, due to perceived reliance on his legal expertise, contributed to her situation. She alleges that Gomez did not actually progress her case, leading her to feel trapped in a non-functional attorney-client dynamic.
This latest lawsuit comes nearly four years after a wave of allegations against Gomez surfaced publicly. In July 2021, several judges of the San Diego Superior Court received unsigned letters from multiple women accusing Gomez of behaviors including unwanted touching and inappropriate sexual comments. Gomez denied those claims, arguing they were part of a coordinated effort by rival attorneys to damage his reputation.
Subsequently, in late 2023, Gomez filed a lawsuit against the Consumer Attorneys of San Diego, alleging that the organization endorsed the dissemination of damaging accusations about him. However, Gomez withdrew this complaint a few months later.
The current lawsuit has been assigned to Judge Richard Whitney and seeks a jury trial. Although the defendants have yet to respond formally within the court, a case management conference is scheduled for September.
