Officer cleared in shooting of driver who attempted to run him over, according to Montgomery County District Attorney.
Montgomery County District Attorney Kevin Steele announced on Friday that a Plymouth Township police officer acted within the bounds of the law when he shot a 21-year-old man who had attempted to use his vehicle as a weapon during a confrontation last month. The incident took place on October 24 in the parking lot of a Doubletree Hotel located on Fountain Road during an attempted traffic stop.
The officer, whose identity has not been disclosed, fired six shots at Dalton Janiczek, a local resident, in response to the aggressive actions of Janiczek, who reportedly drove his Mercedes G63 SUV at the officer with the intention to injure or kill him. Steele emphasized that the officer’s response was a necessary measure for both his own safety and the protection of bystanders present in the vicinity.
According to the investigation, Janiczek sustained only minor injuries from the incident, including a graze wound to his head. He has since been charged with attempted murder of a police officer and related offenses and is currently being held in custody without the option for bail. His attorney has declined to make any public statements regarding the situation.
Preceding the confrontation with the Plymouth Township officer, Janiczek allegedly threatened to detonate explosives at a police station in Chester County, prompting police to attempt to apprehend him. When he encountered the officer in the parking lot, he accelerated towards the officer’s location in a clear act of aggression, leading to the decision to use lethal force.
During the confrontation, the officer initially fired at the windshield of Janiczek’s vehicle. However, he was subsequently struck by the SUV, resulting in injuries that required multiple surgeries for recovery. As the officer lay injured on the ground and attended to himself, Janiczek reportedly hit him with the vehicle on several more occasions.
Following the initial altercation, Janiczek attempted to evade capture by driving recklessly, ultimately leading to a collision with another police vehicle. He also collided head-on with a vehicle driven by a Plymouth Township police sergeant, who suffered leg injuries and required hospitalization.
After the final crash, law enforcement successfully apprehended Janiczek. While being detained, he allegedly threatened police officers, asserting his intent to kill one officer if not restrained. The case continues to unfold, prompting ongoing scrutiny regarding the use of force by law enforcement and issues surrounding public safety.
