Brooklyn shootout suspects face federal firearms charges following incident.
Two individuals involved in a violent altercation in Brooklyn have been charged with federal firearms offenses, following an incident that escalated into gunfire on Tuesday evening. Video evidence shows the first suspect, Aaron Richard, 35, engaged in a confrontation with a second individual, Edynesson Bauduy, 22, near the intersection of Ocean Avenue and Church Avenue in the Flatbush neighborhood. Reports indicate that Richard initiated the conflict by physically assaulting Bauduy, who subsequently brandished a firearm and discharged it towards Richard.
In a swift response, Richard retrieved a handgun from his clothing and returned fire. The New York Police Department (NYPD) received reports of gunfire around 7:30 p.m. and dispatched officers to the scene. Upon arrival, the officers encountered Bauduy, who had remained on site. In the process of intervening, the officers discharged their weapons, striking Bauduy in the leg. He was subsequently transported to Kings County Hospital, where he is reported to be in stable condition.
Officials later recovered Bauduy’s handgun, a Ruger 9mm pistol, at the scene, along with spent shell casings from Richard’s weapon, which was identified as a Spear .380. Both suspects are facing federal charges due to their status as convicted felons found in possession of firearms. This incident has drawn scrutiny, prompting discussions on the broader issues of gun violence and recidivism in the community.
Acting U.S. Attorney for the Eastern District of New York, Joseph Nocella, emphasized the federal commitment to addressing gun violence and the dangers posed by individuals who repeatedly engage in criminal behavior, despite prior encounters with law enforcement. Both suspects were released from prison earlier this year, with records reflecting previous convictions, including armed robbery and assault.
Richard was apprehended at his residence early Thursday morning. His defense attorney, Marissa Sherman, has raised concerns about the legitimacy of his arrest, suggesting that the officers lacked an arrest warrant. However, prosecutors maintain that the arrest was conducted based on probable cause.
During his arraignment in Brooklyn Federal Court, Richard appeared in casual attire and was denied bail, classified as a flight risk based on his criminal history. Bauduy also has a lengthy record, previously arrested for violent offenses, and was released on parole only weeks before the shooting incident.
