Judge denies medical release request for Oscar Belgal, the man shot by ICE in New York City.

A federal judge has denied a motion for emergency release filed by attorneys representing Oscar Belgal, an undocumented immigrant who was shot in the neck by Immigration and Customs Enforcement (ICE) agents in the Bronx. The ruling, issued by Judge Hector Gonzalez, concluded that the legal requirements for emergency release were not met, despite arguments from Belgal’s legal team regarding his medical needs.

Belgal’s attorneys contended that their client required outpatient medical treatment which could not be adequately provided while he remains in detention. They raised concerns about his physical health potentially deteriorating if he was not released. However, Judge Gonzalez emphasized in his ruling that the attorneys failed to meet the judicial threshold for such a release.

The government’s submissions indicated that Belgal had undergone a full medical evaluation at the Brooklyn Hospital Center, which determined he did not require acute surgical or specialized medical care at that time. This evaluation played a significant role in the judge’s decision, indicating that Belgal’s medical needs could be managed while in custody.

The Legal Aid Society, which represents Belgal, expressed disappointment with the ruling, emphasizing the implications for Belgal’s health and dignity. They noted that the decision raises significant concerns about the treatment of individuals in detention and whether their rights are being adequately considered.

The incident leading to Belgal’s hospitalization occurred on October 8, when ICE agents fired seven rounds at his vehicle, striking him while his five-year-old son was in the backseat. The agents claimed that Belgal “weaponized his vehicle,” alleging he accelerated toward them during an attempted arrest. Fortunately, the child was unharmed during the incident.

Department of Homeland Security (DHS) officials identified Belgal as a “criminal illegal alien” from the Dominican Republic and stated that he was wanted by ICE. Furthermore, DHS Secretary Markwayne Mullin indicated in a press briefing that Belgal had affiliations with the Trinitarios street gang and may have knowledge of a prior shooting involving a federal officer in Manhattan.

The shooting has ignited widespread protests concerning ICE’s presence and practices in urban areas, drawing criticism from various community leaders and activists. New York City Mayor Mamdani condemned the event as an “outrage” against the community, labeling ICE as an agency that promotes chaos and fear within neighborhoods.
