Elon Musk’s xAI and SpaceX are facing legal action from Mississippi residents who allege that a nearby power plant, vital to the operation of local data centers, is inundating their community with persistent noise and vibrations that have detrimental effects on their health and property values. The lawsuit, made public on Tuesday in federal court in Oxford, Mississippi, claims that the negligence of Musk’s companies has resulted in a public nuisance due to what the residents describe as “omnipresent and inescapable” noise. A total of three plaintiffs have filed the case on behalf of an estimated class of over 10,000 individuals affected by the disturbances.
According to the lawsuit, “The artificial intelligence boom is wreaking havoc on communities across the United States” by subjecting thousands of residents to the incessant clamor that threatens their quality of life. The plaintiffs are seeking compensation not only for alleged emotional distress but also for diminished property values and various other harms. Additionally, they are requesting the disgorgement of unspecified profits accrued by the defendants.
Responses from SpaceX and xAI have yet to be received regarding the lawsuit, and it is noteworthy that Musk himself is not named as a defendant. The power plant in question, located in Southaven and supported by over billion in investments from xAI and Mississippi Governor Tate Reeves, employs gas-fired turbines to supply electricity to data centers in and around the region. The civil rights organization NAACP previously filed a lawsuit against xAI concerning the plant’s operations, asserting that environmental regulations were violated, a case which remains pending.
Furthermore, the U.S. Department of Justice indicated in a recent court filing that it may step in regarding the NAACP lawsuit, signaling the potential legal and policy challenges that could emerge surrounding government oversight of AI infrastructure.
